In most Illinois medical malpractice cases, you have two years from the date you knew, or reasonably should have known, that medical negligence caused the injury. This is known as the “discovery rule.” However, Illinois also has a statute of repose, which generally bars medical malpractice claims more than four years after the date of the negligent act, regardless of when the injury was discovered. For minors, special rules apply. A birth injury claim on behalf of a child must generally be filed within eight years of the negligent act, but no later than the child’s 22nd birthday.
