About Ryan Injury Attorneys

In Ohio, medical malpractice claims generally must be filed within one year, which is much shorter than the two-year deadline for most personal injury cases. That one-year clock usually starts on the later of two dates: when the doctor-patient relationship for the condition ends, or when you discovered, or reasonably should have discovered, the injury. Two other rules are critical. First, sending the provider a written notice-of-intent letter before the year runs can extend the deadline by 180 days (Ohio Revised Code § 2305.113). Second, a four-year statute of repose bars most claims filed more than four years after the treatment, no matter when the harm is discovered, though narrow exceptions exist for injuries that could not reasonably have been found in time. Because these deadlines are strict and unforgiving, it is best to consult an attorney as soon as you suspect malpractice.
