Code § 6-5-482(b), a child who was under four years old at the time of the negligent act has until his or her eighth birthday to bring a claim. Alabama's general rule pausing deadlines for minors does not override the four-year bar for a child who was four or older when the malpractice occurred, and Alabama's appellate courts have upheld that framework. In practical terms, a child's medical malpractice claim can expire years before that child reaches adulthood — so if you believe your child was harmed by medical negligence, including a birth injury, do not assume there is still time.
